Terms of Service

HeySong is a hosted music generation studio. You describe a track in natural language and we route the request to one or more third-party generative audio providers, then return the resulting audio, its structure map and associated metadata.

We are a software platform, not a record label, publisher or distributor. We do not register your works with any collecting society.

• You must be at least 13 years old, and old enough to enter a binding contract in your jurisdiction, to hold an account.
• You are responsible for the accuracy of your account details and for all activity under your credentials.
• One human, one account. Automated account creation is prohibited.
• We may suspend an account that presents a security, legal or abuse risk, with notice where practicable.

Generations are paid for with credits. Plans are Starter (free, $0/mo), Creator Pro ($9.99/mo), Creator Pass — Quarterly ($24.99/quarter), Creator Pass — Yearly ($89.99/year), and the BYOK Engine Pass ($29.99 one-time plus $4.99/mo cloud maintenance).

• Credits are deducted only when a generation completes successfully; failed generations are refunded automatically.
• Credits included with a paid plan roll over for twelve months from the date they are granted. Promotional credits may carry their own expiry.
• Subscriptions renew automatically at the end of each billing period until cancelled. Cancelling stops future renewals; it does not retroactively refund the current period.
• The BYOK Engine Pass one-time fee is non-refundable once the key panel has been unlocked and used. Cloud maintenance is cancellable at any time and lapses at the end of the paid period.
• Prices are in US dollars and exclusive of any applicable taxes, which are added at checkout.

You retain all rights you hold in the prompts you write, the lyrics you supply and the audio you generate. We claim no ownership over them.

You grant us a limited, worldwide, non-exclusive licence to host, process, cache and transmit your content strictly for the purpose of operating and improving the service for you — including sending it to the third-party providers that render your audio. This licence ends when you delete the content, except where we must retain it to comply with law.

We do not use your prompts or generated audio to train generative models, whether ours or a third party’s.

You must not use HeySong to:

• Impersonate a specific artist, or generate content designed to sound like an identifiable performer without their consent.
• Reproduce copyrighted lyrics, melodies, recordings or compositions you do not control.
• Attempt to bypass, disable or mislead our prompt-safety systems or those of our providers.
• Generate content that is unlawful, defamatory, sexually explicit, harassing, or that promotes violence or hatred.
• Reverse-engineer, resell, or provide the service as a substitute for our own API without a written agreement.
• Circumvent credit accounting or rate limits.

We screen prompts before dispatch and may rewrite or refuse a request. Refusals do not consume credits.

Paid plans grant you a worldwide, royalty-free licence to use audio you generate for commercial purposes, including monetised video, streaming distribution and client work. The Starter plan is licensed for personal, non-commercial use only.

This licence covers our contribution. It does not and cannot warrant that a given generation is free of third-party claims, because generative output is probabilistic. You are responsible for clearing your own use of the audio, including any similarity check a distributor or platform requires. We provide an originality pre-flight and, on paid tiers, similarity screening to reduce this risk.

BYOK lets you route generation through your own provider accounts. You are solely responsible for those accounts, for their terms, and for usage charges they incur. Keys are encrypted at rest with AES-256-GCM and are never returned to your browser or written to our logs.

If your cloud maintenance plan lapses, your account reverts to platform credits. Your stored keys are retained so the panel resumes working immediately when maintenance restarts; you may delete them at any time.

We aim for high availability but do not guarantee uninterrupted service. Generative providers may impose their own outages, rate limits or model retirements; where a model is withdrawn we will substitute a comparable engine or refund affected credits.

We may update these terms. For material changes we will notify you by email or in-product at least 14 days before they take effect.

The service is provided “as is”. To the maximum extent permitted by law we exclude all implied warranties. Our aggregate liability arising from the service is limited to the greater of the fees you paid us in the twelve months preceding the claim, or one hundred US dollars.

Nothing in these terms limits liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.

You may close your account at any time from settings. We may terminate for material breach of these terms with notice and a reasonable cure period, or immediately for unlawful use.

These terms are governed by the laws of the jurisdiction in which HeySong is established, without regard to conflict-of-law rules. Mandatory consumer protections in your country of residence continue to apply.
